Nairobi, August 2024 – Chief Justice Martha Koome has officially published the Employment and Labour Relations Court (Procedure) Rules, 2024. This new legal framework outlines a comprehensive process for handling disputes, appeals, and case management within the Employment and Labour Relations Court.

In a landmark decision on August 16, the Employment and Labour Relations Court issued a ruling that strengthens the protection of employee rights, establishing a new standard in labor law. This ruling, considered a milestone in the evolution of labor law, acts as a crucial safeguard for workers’ interests while clarifying employers’ obligations.

The case at the center of this ruling involved a major corporate employer and several of its former employees, who alleged unfair dismissal and inadequate compensation. The Court’s decision, which followed extensive deliberation, not only vindicated the employees but also established clear guidelines that would shape the handling of future labor disputes across the country.

One of the most significant aspects of the ruling was the Court’s reaffirmation of the right to a fair hearing before any dismissal. The employer had argued that the employees were dismissed for cause, citing performance issues and misconduct. However, the Court found that the employer had failed to provide a proper platform for the employees to defend themselves, thereby violating their right to a fair hearing as stipulated under the Employment Act, 2007.

The Court emphasized that employers must adhere strictly to due process when handling dismissals, including providing clear reasons for termination and allowing employees the opportunity to contest those reasons.
